HB 675 Florida
« on: December 24, 2020, 06:49:16 PM »
The bill is the summary. ANRR thinking again. It may be practical, but it strengthens anti-nudity.

Why do I say ANRR? Does this carrot in front of the legislators eyes helpful? From safe free beaches, perhaps public opinion will grow less ignorant?

Here is what I got in this morning's email.

Could you summarise this legislation, please Jbee.  It doesn't look naturism positive to me as you and the video say.  I must have got it wrong somewhere.

As I thought - draconian legislation outlawing nudity with increased penalties.  What's good about it?

"CS/HB 675 — Exposure of Sexual Organs
by Judiciary Committee and Rep. Mercado and others (CS/SB 1018 by Criminal Justice Committee and Senator Stewart)

This summary is provided for information only and does not represent the opinion of any Senator, Senate Officer, or Senate Office.

Prepared by: Criminal Justice Committee (CJ)

The bill increases the penalty from a first degree misdemeanor to a third degree felony for a second or subsequent offense of the unlawful exposure of sexual organs. The bill also specifies that being naked in public in a vulgar or indecent manner is a violation of s. 800.03, F.S.

The bill provides that exposing of sexual organs by a mother breastfeeding her baby, or a person who is merely naked at a place provided or set apart for that purpose is not a violation of s. 800.03, F.S.

The bill adds the crime of exposure of sexual organs to the list of misdemeanor offenses for which an officer may conduct a warrantless arrest.

If approved by the Governor, these provisions take effect October 1, 2020.

Vote: Senate 37-1; House 118-0"

It recognizes free beaches, if ya got 'em...and resorts (ala ANRR) BUT, it makes genitals, just genitals illegal, if presented in a nasty sort of way, which was illegal all ready.

There are a few beachheads set for expansion into the rest of Florida, there can be more, now. Perhaps eventually, there will be enough of them to change public attitude and norms about the body. It is a trade off. It is progress, but does it have potential to liberate or bodies?

I don't like the sound of this law at all, but apparently the Florida naturists aren't worried about it. I suppose they know what's important.

here is the statute "800.03 Exposure of sexual organs.—

(1) A person commits unlawful exposure of sexual organs by:

(a) Exposing or exhibiting his or her sexual organs in public or on the private premises of another, or so near thereto as to be seen from such private premises, in a vulgar or indecent manner; or(b) Being naked in public in a vulgar or indecent manner."

(2) a&b (about punishment)

(3) The exposure of sexual organs by any of the following does not violate this section:

(a) A mother breastfeeding her baby; or

(b) An individual who is merely naked at any place provided or set apart for that purpose.

I'm not a lieyer, but reading 1a and 3b together appears to mean" Being naked in public is legal as long as you aren't doing so "in a vulgar or indecent manner." You can be naked at a place set apart for the purpose of nudity even if you do so "in a vulgar or indecent manner."

Like all lieyers they don't define "merely naked" nor what is a "vulgar or indecent manner."

It would be a lot more human friendly if they just repealed these tyranny laws and just said that FREEDOM is up to each individual to decide what clothing to wear or not.
Human bodies are natural, comfortable, and green.

Yea, and the definition of "sexual organs" seems to vary from place to place. The whole body is generally a sexual organ, unless specific about biological parts, which is genitals only. Then, which parts of the genitals are sexual function? If they are being used to pee with at the time, are they still sexual organs? Seems that when they are put to use for sexual gratification they can be defined as sexual organs. Thus this thing about lewd and lascivious. So, what is vulgar, or indecent supposed to connote??

If we aren't able to cipher this thing effectively, then, how about a cop out on the street?

People put on clothing just to be provocative, to feel sexy, to attract others, to send the "available" message out there, very very often. Seems like if you really wanted to look less vulgar, or less indecent, then you would get undressed as God intended, as a safe fallback state.
