Davie,

As a matter of curiosity, is it possible to bring a private prosecution for trespass? (Just wondering, as I have a degree in pedantry :D)

Have fun,

No as in general terms there is no crime of trespass so you can bring a civil action. That is suing someone. There are some statutory crimes of trespass e.g. on the railway, on MOD land (but you might get shot as an alternative to prosecution!)

My original sign was posted primarily to stop my neighbor from driving his truck across my land. "Private Property -- No Motorized Vehicles."  I added the "Clothing Optional Area" as an afterthought.  It was only posted on the back of my land where I walk frequently but visitors have no reason to go.  Its been posted for about a year and all this discussion got me to thinking about posting the front side of my land and particularly my driveway.  So this past week I put a new sign together and posted one on each side of my driveway.

Here is my new sign. My wife calls the property "Glenconey"

Here I am standing by the sign.
You can just barely see my neighbor's shed in the distance across the county road on the right.

This sign is on the passenger side (in the US) so there is a second sign on the driver side a little way farther up.   I've also posted a few more signs along my north and south boundaries.   They suggest that walking visitors are welcome with or without clothes.

When you have that sort of property this seems to be the right way to go about it.

Bob,
Do you get many people walking on your land or vehicles crossing?

Hardly any walkers visiting.  I think I get more motorized vehicles tearing up the land in spring when its muddy.  And more cows too.  However there is another new house being built a few plots south of my far side, so the neighborhood is getting more crowed.   Some of my friends have mentioned that they may come out and wander about naked but none have showed up yet.

You need to invite them for a naked ramble round your land and see who turns up!  :D

I actually have invited several friends to come out and enjoy the woods, but nobody shows up.

This reminds me of that old traditional party.

"Come as you are." Which most people don't do.

They always 'fix up' before leaving. You could vary it by adding a 'grab something from the fridge' before you leave and just do cook out.

Well I hope this isn't too illegal, what with the State Parks logo on the sign and all.

Here is the sign that was posted.

Nice, the way you incorporated their official logo. No telling how a ranger might react. Laugh and leave it, not notice it, call in to ask if its real, take finger prints and go looking for naked people because it impersonated law enforcement...who knows.

Since there are no fed laws, it isn't incorrect. The state law is concerned with alarm, or reasonable affront. Unless they can attach you to the sign, you now should have no problem. The laws and the official sign should replace the need to clothing, it is a license to be naked and have hassle free fun. It should be seen as a prank and they might remove it.

Maybe I should get me one and a pair of plastic gloves. I could post at each trail-head, and eliminate the need for back up clothing, or concern. "Hey, didn't you read the sign? This trail is officially clothing optional."

If the best idea is to not stir up complaints, then this might not be a good idea in other states...or it might be a good idea.
