They Are Still Out There!
« on: June 13, 2017, 12:55:11 AM »
There are still laws on the books that are a threat to your everyday life. This one , passed in 1957, is cleverly written so as to make it illegal to even discuss revoking it.

Quote from: from article
He said that, to his knowledge, Arkansas is the only state that has a law specifically criminalizing the practice of nudism.

The temptation is to pile on because it’s Arkansas, but I have seen articles before listing odd, weird and outdated laws still in force in all 50 states. It’s one of the risks of having a government run by everyday people. Sometimes laws get passed that genuinely make you scratch your head.

This one actually makes your skin crawl. I’ve visited Arkansas and it’s a state blessed with natural beauty. But after reading this, I would never live there.

Yes, it was the retentive ‘50’s. Yes, it’s in the south. Yes, it’s in the Bible-belt.
But then again it is Arkansas.

In this article a male politician from one of the New England states, blatantly states that if he sees a barechested woman and is motivated by seeing an exposed breast, it is only natural, and acceptable, to reach out and grab.

Quote
“If it’s a woman’s natural inclination to pull her nipple out in public and you support that,” Moore wrote in a Facebook post, “than you should have no problem with a mans inclantion [sic] to stare at it and grab it. After all... It’s ALL relative and natural, right?”

These people not only are still out there but hold offices of responsibility in a part of the country you don’t normally think of as backward, i.e. Arkansas.

National politicians also, but I can't give names without being way politically volatile. Not very long ago, judges of rape victims, "Short skirt is inviting a rape, let 'em go." These people just can't understand inviting to look, for various reasons, does not mean grope me, touch me, or rape me. Anyone has the ability to comply with the boundary with a minimum of self control.

Also, "yea, we are naked naturists and like that. This doesn't mean that we are swingers, naked for your benefit, or appreciate advances." Lots of ignorance from small self centered and ignorant minds. It can occur anywhere, in any social strata and any country. Nobody teaches them the wrong in it. They get taught that it is okay behavior.

I had a Frenchman, you know of the liberated French people, physically assault my wife at the restaurant on the beach in Saint Martin. I caught him and his friend trying hold her down and rape her in the toilet. Completely naked myself, I broke off the bottom of the greeny in my hand and went to go to work on them. They ran. Didn't come back. Guess I got lucky that I didn't get a piece of them. No telling what a French judge would do. He might have sided with them.

One of my friends told me, "See, you let her run around naked like that and that is what happens." Found out later that he had less direct ways to mess with women, but you see it is wide spread and they believe that that stuff is okay.

It is assault and it is rape. It is a serious and damaging act. Los Angeles, or Podunk, Arkansas, or Paris, France. It is why some people go to reservations, they feel safer and respected.

Well, that's New Hampshire for you.

But this notion that nudism is illegal in Arkansas just won't go away, even if it's false. False? Yes, naturism's legal as long as it doesn't involve people of both sexes. Which of course free-range naturism rarely does, so we haven't got any problems there.

As used in this section, "nudism" means the act or acts of a person or persons congregating or gathering with his, her, or their private parts exposed in the presence of one (1) or more persons of the opposite sex as a form of social practice.

Oh my! You have to have sex with your wife with your cloths on!?! A mother can't give her child a bath!?! This law needs a firm challenge in court.

Read the actual text of the law, JBG:
http://naturistaction.org/StatesFrames/State_Laws_Frames/Arkansas_Laws/arkansas_laws.html

It defines nudism as "a form of social practice" which I think would leave domestic situations out. And anyway, it allows for exceptions for medical treatment, and also if "The persons are married legally one to another". But that leaves you and DF in a difficult position! I'd say if you visit Arkansas, better keep your clothes on and don't talk about being naked.

The post wasn’t about the wording of the law itself, although that discussion is important.

The law should be declared unconstitutional. Not for the part about nudity, but about suppressing speech. My post was pointed at the neolithic thinking in a time and area that created that piece of legislation. And, “It’s Still Out There!

A law on the books that punishes speech about the law is flat out unconstitutional and should be declared so. Quibble all you want about shades in the subject of the text, the text is quite clear on how it violates the 1st amendment.

That and the culture that spawned it is what I was driving at.
Sorry for not making that more clear.  :P :D
